
How to Enter
The Entry Process
The ArtVenture Freedom to Create Prize is not a typical art prize. It will not simply judge the skill of the artist but rather recognises how the artist has used their work to promote awareness and alert people to the plight of others. The inaugural prize is a unique and significant award and will be judged by a panel comprised of eminent artists, commentators and human rights experts.
Entry Requirements
- Journalism pieces will not be considered.
- Entries in contravention of the Universal Declaration of Human Rights in the opinion of ArtVenture and ARTICLE 19 will not be considered.
- Entries must be typed. Handwritten entries will not be accepted.
- Each artist and/or group can only enter/be nominated once and fill in the appropriate entry form for the relevant prize category.
- In the event a group is selected as the winning entry, prize monies will be divided equally amongst all nominated members.
- Entrants can enter either one piece of art or a body of work but can only submit one application form. Please refer to the web site www.freedomtocreateprize.com for an overview of what constitutes ‘art’.
- All sections in the application form must be completed.

903121 - Deadline for submission is October 31, 2008 at 2359 hours (UTC/GMT + 8 hours). On-line registration and email applications must be submitted by this date. Postal applications will only be accepted up to the close of business in Singapore on November 10, 2008. Entries will only be accepted if the emailed version of the application AND the hardcopy are received.
- Entrants should select materials which best represent their artwork.
- Photographs and/or video and/or samples of the art works must be attached to the posted entry for the main Freedom to Create Prize and the Freedom to Create Youth Prize. A file containing the photographs and or video and/or sample of the artwork should also be emailed along with the entry to entry@freedomtocreateprize.com. Photographs will only be accepted in the following formats: jpeg, tif, gif. Videos will only be accepted in the following formats: wmv, mpeg, mp4. For the Freedom to Create Imprisoned Artists Prize, any photographs and or video showing the work should also be included, if available, as verification that the works existed. Other forms of verification may also be accepted at ArtVenture and ARTICLE 19’s discretion.
- Entrants and nominating parties are not to send original copies of the artwork/s and ArtVenture and ARTICLE 19 accept no responsibility for any materials submitted with the entry.
- ArtVenture and ARTICLE 19 will not return any materials posted for consideration in any of the ArtVenture Freedom to Create prize categories.
- All entry costs (including postage) will be borne by each entrant or the nominating parties.
- Entrants must provide as much detail as possible as to what purposes they intend the prize money to be directed towards. Release of the prize monies will be subject to entrants providing satisfactory evidence of their intended use of prize monies and may be asked to sign a release form before any prize monies are paid, requiring winners to submit evidence of how the prize monies have been spent.
- Referees must be familiar with the work of art and not a personal acquaintance of the entrant.
- Each entrant must provide full contact details of three referees who may be contacted as part of the judging process.
- The works of art being considered for the Freedom to Create Prize and the Freedom to Create Youth Prize must have been disseminated to the public within a reasonable time period after their creation. ArtVenture and ARTICLE 19 reserve the right to define what is reasonable for these purposes.
Terms & Conditions
The ArtVenture Freedom to Create Prize (the “Prize”) is sponsored by Artventure Holdings Limited (“ArtVenture”), a BVI company with registered number 643473. The Prize is promoted by ArtVenture and by ARTICLE 19 (“ARTICLE 19”), a UK charity with registered number 327421.
The conditions set out in the applicable entry form on the Prize website at www.freedomtocreateprize.com (the “Website”) and following terms and conditions (together, the “Terms and Conditions”) govern the Prize. If you do not agree with the Terms and Conditions, please do not enter the Prize.
- PRIZE CATEGORIES
- There will be a total of three Prize winners (each, a “Winner”) among the artists (each, an “Artist”) who enter the Prize, as follows:
- Winner: ArtVenture Freedom to Create Prize;
- Winner: ArtVenture Freedom to Create Youth Prize; and
- Winner: ArtVenture Freedom to Create Imprisoned Artist Prize.
- Each Winner will receive his or her Prize in accordance with and subject to the Terms and Conditions.
- Prizes are not transferable or redeemable for cash equivalents or other prizes.
- WHO CAN ENTER
- The Artist must be over 18 years of age on 31 October 2008 to enter the ArtVenture Freedom to Create Prize.
- The Artist must be under 18 years of age on 31 October 2008 to enter the ArtVenture Freedom to Create Youth Prize.
- There are no age restrictions on an Artist’s ability to enter the ArtVenture Imprisoned Artist Prize.
- If the Artist is under 18 years of age on 31 October 2008, they must be represented by a nominating party (a “Nominating Party”) who enters the Prize on his or her behalf. Each Nominating Party must (i) be over 18 years of age on 31 October 2008, (ii) agree to the conditions set out in the Terms and Conditions on behalf of the Artist and (iii) obtain the Artist’s parent’s or legal guardian’s consent before entering the Prize. By submitting a Prize entry, the Nominating Party represents and warrants that they have obtained the full, informed consent of the Artist to such entry and have authority to accept the Terms and Conditions on behalf of the Artist. ArtVenture reserve the right to disqualify entries submitted without such authority.
- Directors, officers, employees, contractors and their immediate families of ArtVenture, ARTICLE 19 and their associated agencies and companies may not enter the Prize.
- HOW TO ENTER
- Entry requirements and other information such as judging criteria are set out in the entry form for each Prize category on the Website.
- As conditions of Prize entry, the Artist:
- warrants and represents that they created and own all rights in and to the artwork submitted for the Prize; and
- warrants and represents that their submitted artwork is original and does not infringe the intellectual property or other rights of any third party.
- TO WIN
- The panel of Prize judges shall choose each Winner from among valid entries received in accordance with the Terms and Conditions and the criteria set out on the Website. Chance plays no part in determining the Winners.
- The panel’s choice of each Winner is final. Neither ArtVenture nor ARTICLE 19 will enter into any correspondence with Artists (other than Winners as necessary) regarding any such choice.
- Each Winner will be notified of winning their respective Prize category by email on or before 30 November 2008. ArtVenture will also attempt to contact each Winner by telephone to the extent possible and appropriate, but will accept no responsibility for failure to notify Winners. Artists should, if possible, check the Website to confirm whether they are a Prize Winner.
- It is a condition of accepting a Prize that the Winner of such Prize agrees to comply with all of ArtVenture’s conditions on use of the Prize monies, including providing evidence of expenditure (including allocation) of the Prize monies within a period of ninety days after receiving such monies.
- MEDIA AND PERSONAL DETAILS
- The Artist agrees to participate and co-operate, to the extent possible, as required in all editorial activities relating to the Prize, including being interviewed and photographed by ArtVenture and the media, and to the posting of his or her profile and artwork on the Website; and
- The Artist irrevocably grants to ArtVenture and their subsidiaries and affiliated companies a royalty-free, non-exclusive license to use, distribute, reproduce, modify, adapt, and publicly display the submitted artworks in any media for the purpose of promoting, conducting and commemorating the Prize, without additional review, compensation, or approval from the Artist or any other party. For the avoidance of doubt, nothing in the Terms and Conditions is intended to operate as an assignment of any rights in the artwork submitted with the Artist’s Prize entry and all such rights shall remain with the Artist.
- The Artist consents to ArtVenture and ARTICLE 19 obtaining their email address, if any, and other personal details submitted with their entry and using that information for the purposes of judging the entry, notifying Winners, promoting the Prize and otherwise in accordance with the Terms and Conditions.
- All personal details of the Artist will be treated in accordance with ArtVenture’s privacy policy located at: http://www.artventure.com/privacy.asp.
- LIMITATION OF LIABILITY
- SUBJECT TO ANY RESTRICTIONS IN AND TO THE EXTENT PERMITTED BY ANY LOCAL LAWS, THE LIABILITY OF ARTVENTURE AND ARTICLE 19 AND ANY OF THEIR RESPECTIVE AFFILIATES, ASSOCIATED COMPANIES, DIRECTORS, OFFICERS, OR EMPLOYEES, TOWARDS ALL ARTISTS HOWEVER CAUSED (INCLUDING NEGLIGENCE) IS LIMITED IN AGGREGATE TO ONE THOUSAND SINGAPORE DOLLARS (SGD 1,000).
- SUBJECT TO ANY RESTRICTIONS IN, AND TO THE EXTENT PERMITTED BY, ANY APPLICABLE LOCAL LAWS, NEITHER ARTVENTURE NOR ARTICLE 19 NOR ANY OF THEIR RESPECTIVE AFFILIATES, ASSOCIATED COMPANIES, DIRECTORS, EMPLOYEES OR AGENTS, SHALL HAVE ANY LIABILITY TO ANY ARTIST FOR ANY INDIRECT OR CONSEQUENTIAL LOSS, OR FOR ANY LOSS OF PROFITS, HOWEVER ARISING IN RELATION TO THE PRIZE.
- IN ADDITION TO ANY OTHER RIGHTS, ARTVENTURE RESERVES THE RIGHT AT THEIR SOLE DISCRETION TO DISQUALIFY ANY INDIVIDUAL WHO TAMPERS WITH THE ENTRY PROCESS INCLUDING, WITHOUT LIMITATION, THROUGH FALSIFYING ENTRY FORM INFORMATION OR SUBMITTING ARTWORK WHICH WAS NOT CREATED BY THE ARTIST, OR THE OPERATION OF THE PRIZE AND/OR IS DETERMINED AT ARTVENTURE’S ABSOLUTE DISCRETION TO BE ACTING IN VIOLATION OF THE TERMS AND CONDITIONS.
- ARTVENTURE RESERVES THE RIGHT AT ITS SOLE DISCRETION TO CANCEL, TERMINATE, MODIFY OR SUSPEND THE PRIZE AND SELECT WINNERS FROM AMONG ALL ELIGIBLE ENTRIES RECEIVED PRIOR TO THE CANCELLATION.
- NEITHER ARTVENTURE NOR ARTICLE 19 OR THEIR ASSOCIATED AGENCIES AND COMPANIES WILL TAKE ANY RESPONSIBILITY FOR PRIZES DAMAGED OR LOST IN TRANSIT, OR LOST, LATE, MISDIRECTED, ILLEGIBLE OR MUTILATED ENTRIES OR FOR ANY COMPUTER, ONLINE, TELEPHONE OR TECHNICAL MALFUNCTIONS THAT MAY OCCUR.
- SUBJECT TO ANY RESTRICTIONS IN AND TO THE EXTENT PERMITTED BY ANY APPLICABLE LOCAL LAWS, NEITHER ARTVENTURE NOR ARTICLE 19 OR ANY OF THEIR RESPECTIVE AFFILIATED OR ASSOCIATED AGENCIES AND COMPANIES WILL BE LIABLE FOR ANY MISADVENTURE, ACCIDENT, INJURY, LOSS (INCLUDING BUT NOT LIMITED TO CONSEQUENTIAL LOSS) OR CLAIM THAT MAY OCCUR IN CONNECTION WITH THE PRIZE OR THE WINNER’S PARTICIPATION IN THE PRIZE.
- GOVERNING LAW AND JURISDICTION
- ArtVenture has organised the Prize, and control and maintain the Website from Singapore and make no representation that the material and information contained in the Website is appropriate or available for use in any other locations or jurisdictions.
- All rights and obligations and all actions contemplated by the Terms and Conditions shall be governed by the laws of the Republic of Singapore, including the provisions of the Singapore Evidence Act (Chapter 97) and the Singapore Electronic Transactions Act (Chapter 88).
- All decisions of ArtVenture are final and may not be disputed and no correspondence regarding any decision will be entertained.
- GENERAL CONDITIONS
- Subject to any restrictions in and to the extent permitted by any applicable local laws, by entering the Prize, the Artist releases and holds harmless, each of ArtVenture and ARTICLE 19 and their respective parents, subsidiaries, affiliates, directors, officers, employees, and agents from any liability for any injuries, loss or damage of any kind to persons, including death, or property damage resulting in whole or part, directly or indirectly, from acceptance, possession, misuse or use of any Prize, participation in this promotion, or while travelling to, preparing for, or participating in any Prize-related activity.
- ArtVenture reserves the right to change the Terms and Conditions, the Prize’s judging criteria, to withdraw any or all Prize categories or cancel all or part of the Prize in their absolute discretion without notice.
- The Artist acknowledges and agrees that the Terms and Conditions constitute the complete and sole agreement between ArtVenture concerning their participation in the Prize, and supersede and govern all prior proposals, agreements, or other communications between the Artist and ArtVenture or ARTICLE 19 which relate to the Prize.
- Any failure by ArtVenture to require any Artist’s performance of any provision of the Terms and Conditions shall not affect the full right of ArtVenture to require such performance at any time thereafter, nor shall any waiver of a breach of any provision the Terms and Conditions by ArtVenture be taken or held to be a waiver of the provision itself. In the event that any provision of the Terms and Conditions shall be unenforceable or invalid under any applicable law or be so held by any applicable arbitral award or court decision, such unenforceability or invalidity shall not render the Terms and Conditions unenforceable or invalid as a whole and ArtVenture will amend or replace such provision with one that is valid and enforceable and which achieves, to the extent possible, the original objectives and intent of ArtVenture as reflected in such original provision.
- No term of the Terms and Conditions shall be enforceable under the Contract (Rights of Third Parties) Act of Singapore (“the Act”) by a third party (being any person other than the parties and their permitted successors and assignees), but this does not affect any right or remedy of a third party which exists or is available apart from under the Act.
- AGREEMENT. By submitting a Prize entry, the Artist (or Nominating Party, on behalf of the Artist) agrees to the Terms and Conditions.
